A – Not at this point. In fact, currently, a driver’s status of holding a medical marijuana card cannot be used as:

  • Probable cause for making traffic stops and/or requesting drivers to submit to blood tests
  • Evidence of intoxication by prosecutors later.

Given concerns about privacy and profiling people, it seems unlikely that the state legislature will change this anytime soon.
